Course Description :

This course will introduce the major issues and areas of employment law:

1. In general, the course will address ongoing questions regarding the rights and responsibilities of managers and the availability and appropriateness of the alternative arrangements for monitoring and enforcing of employment law and regulation: courts, administrative agencies, and private arbitrators.

2. Protective employment legislation including Family and Medical Leave Act, Fair Labor Standards Act, Occupational Safety and Health Act, Employee Retirement Income Security Act and Workers’ Compensation.

3. The employment-at-will doctrine and the judicial and statutory erosion of the at-will doctrine, including implied contracts, covenant of good faith and fair dealing, employee rights to free speech and privacy.

4. Private regulations of workplace through employment agreements, proprietary information protections, non-compete agreements, and private arbitration.

5. There will be coverage of the law of collective bargaining and equal employment opportunity laws.
